When can arbitration take place?

In the event of a finding of non-conciliation before the ONC, each group of the Joint Conciliation Committee may refer the matter to the Minister of Labour within two weeks with a view to appointing an arbitrator.

The Minister shall propose an arbitrator to the parties within two weeks of the referral.

The parties must decide on this proposal within two weeks.

What are the consequences of accepting the arbitrator?

Acceptance of the arbitrator by both parties is equivalent to acceptance of the arbitrator’s decision.

The arbitration decision shall be deemed equivalent to the signature of a collective agreement.
